Dear Mrs xxx,
dear Sir or Madam,
the BAM approval is based on packing instruction P910 paragraph 3 in subsection
4.1.4.1 ADR whereas the batteries may be transported unpacked under the approved
conditions of an ADR contracting party with the BAM being the appropriate national
authority in Germany for this. Special Provision 310 in subsection 3.3 of the ADR is
referenced in packing instruction P 910 for the transport of batteries from small
production runs or prototypes without fulfilling the instruction for testing described in
the manual of tests and criteria part III subsection 38.3.
According to special proivison 310 damaged or defective batteries must be
transported in compliance with special provision 376 of subsection 3.3 ADR.
In the assessment whether a battery is damaged or defective as per special provision
376 a valuation or evaluation must be made taking into account the safety criteria of
the cell, battery or product manufacturer or by a qualified technical person with
knowledge of the battery safety features.
The battery manufacturer xx has conducted such a valuation or evaluation and found
that the respective battery equals a used battery and that therefore no damage or
defect as per special provision 376 is present. The transport can therefore be
conducted on basis of the BAM approval.
